Summary: King worked for Gill and Company and kept an account of goods and money loaned to them. Gill and Co. failed to pay the money, and King sued in an action of assumpsit seeking $1,500. Gill and Co. retained Lincoln and pleaded a set-off, arguing that King owed them $1,000. Lincoln also argued that King made incorrect entries in the account. The court called a jury but discharged it when the parties agreed that Gill and Company owed King $504.15. King received $511.65 several months later.
